This website is operated by Kim Van Aesthetics, Inc. Throughout the site, the terms “we,” “us,” and “our” refer to Kim Van Aesthetics, Inc. We offer this website, including all information, tools, products, and services available through it (collectively, the “Services”), conditioned upon your acceptance of these Terms of Service (the “Terms”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

By visiting the site, purchasing from us, or otherwise using the Services, you agree to be bound by these Terms and any additional terms or policies referenced here or available by hyperlink. These Terms apply to all users of the Services, including browsers, customers, merchants, and contributors of content. If you do not agree to these Terms, do not access or use the Services.

We may update these Terms by posting a revised version on this page. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms, to the extent permitted by law.

1. Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state or place of residence, or that you have reached the age of majority and have consented to the use of the Services by any minor dependents under your supervision.

You agree to provide current, complete, and accurate account and purchase information. You are responsible for protecting your account credentials and for activities conducted through your account. Notify us promptly if you believe your account has been used without authorization.

You may not use the Services or our products for any unlawful or unauthorized purpose or violate any applicable law through your use of the Services.

2. Products and Services

We make reasonable efforts to display product descriptions, colors, images, pricing, and availability accurately. However, displays may vary by device, and we do not guarantee that every image or color will appear exactly as it does in person.

Products and services may be available exclusively online and may have limited quantities. We may limit sales by person, household, geographic region, or jurisdiction and may discontinue or change a product at any time. Any offer is void where prohibited.

Unless expressly stated otherwise, product information on the site is provided for general informational purposes. Our skincare and cosmetic products are not intended to diagnose, treat, cure, or prevent any disease and are not a substitute for professional medical advice. Review ingredients and directions before use, perform a patch test when appropriate, and discontinue use and consult a qualified healthcare professional if irritation or an adverse reaction occurs.

3. Orders, Billing, and Acceptance

Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order at our discretion, including because of suspected fraud, pricing or inventory errors, product availability, or unauthorized resale. An order confirmation acknowledges receipt but does not necessarily constitute final acceptance. If we cancel an order after payment, we will refund the amount charged for the canceled portion.

You agree to provide accurate billing, shipping, payment, and contact information and to update that information as necessary. You represent that you are authorized to use the payment method submitted. Applicable taxes, shipping charges, and other charges will be shown during checkout when required.

4. Pricing and Promotions

Prices and promotions may change without notice. A “compare-at” price may show a product’s original or regular price next to a current promotional price. Promotional offers are subject to any stated dates, exclusions, limits, or availability and may not be combined unless expressly permitted.

We reserve the right to correct pricing, promotional, typographical, or other errors and to cancel affected orders, even after an order has been submitted, subject to applicable law. If a correction affects an order already placed, we will provide notice and any refund required by law.

5. Shipping, Returns, and Refunds

Shipping estimates are estimates only and are not guaranteed. Delays caused by carriers, weather, incorrect addresses, customs, or events outside our reasonable control may occur.

Purchases are also governed by our Shipping Policy and Refund Policy, which are incorporated into these Terms. Please review those policies before purchasing.

6. Accuracy and Availability

Information on the site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, availability, or other matters. We may correct errors and update information at any time without prior notice, including after an order is submitted, subject to applicable law.

We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free. We may suspend, withdraw, or modify any part of the Services without notice.

Such access is provided “as is” and “as available.” We do not endorse and are not responsible for third-party materials, websites, products, services, privacy practices, or transactions. 8. Intellectual Property

The Services and their content—including text, graphics, logos, images, product names, designs, videos, and software—are owned by or licensed to Kim Van Aesthetics, Inc. and are protected by applicable intellectual-property laws. You may use the Services only for personal, noncommercial purposes.

Without our prior written permission, you may not copy, reproduce, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit any portion of the Services, except as expressly allowed by law.

9. User Content and Feedback

If you submit reviews, comments, photographs, suggestions, ideas, or other content (“User Content”), you grant us a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that User Content in connection with operating and promoting the Services, subject to applicable law and our Privacy Policy.

You represent that you own or have the necessary rights to submit User Content and that it does not violate another person’s rights or any law. We may remove User Content that we believe is unlawful, offensive, misleading, infringing, or otherwise objectionable.

You may not use the Services to:

violate any law or another person’s rights;
infringe intellectual-property, privacy, publicity, or other rights;
transmit malicious code, viruses, or harmful material;
collect or track others’ personal information without authorization;

We may suspend or terminate access for prohibited conduct.

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Because Shopify hosts the store, Shopify may also collect and process information as described in its own privacy notices.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products delivered through them are provided “as is” and “as available,” without warranties or conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Nothing in these Terms excludes warranties, guarantees, or rights that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Kim Van Aesthetics, Inc. and its directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, revenue, savings, data, or replacement costs, arising from your use of or inability to use the Services or products.

Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law. These limitations do not apply where prohibited or to liability that cannot lawfully be limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kim Van Aesthetics, Inc. and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your material breach of these Terms, violation of law, or infringement of another person’s rights.

15. Termination

These Terms remain effective unless terminated by you or us. You may terminate them by discontinuing use of the Services. We may suspend or terminate your access if we reasonably believe you violated these Terms or applicable law. Obligations and liabilities incurred before termination, and provisions intended by their nature to survive, will remain effective after termination.

16. Governing Law

These Terms and any separate agreements through which we provide Services will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where the law of your residence requires otherwise. Any dispute will be handled in a court of competent jurisdiction, subject to any consumer rights that cannot be waived.

17. Severability and Waiver

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision or any other right.

18. Entire Agreement

These Terms, together with policies and operating rules posted on the site, constitute the entire agreement between you and us regarding the Services and supersede prior or contemporaneous communications relating to the Services. Any ambiguity will not be interpreted against a party solely because that party drafted the Terms.
